Wie die Juristenvereinigung Libertad (Freiheit) im kolumbianischen Medellín mitteilt, wurde der 11 Jahre junge Deiner Andrés Guerra am 21. Februar von Angehörigen der elften Brigade der kolumbianischen Streitkräfte gemeinsam mit seinem Vater und anderen Personen verhaftet. Während mehrere der Verhafteten nach wie vor verschwunden sind, wurde die Leiche des Kindes verscharrt auf dem Gelände einer Finca entdeckt. Die Juristenvereinigung fordert, daß keine Ageghörigen der Briagde XI der Armee an den Ermittlungen dieses Falls beteiligt werden, um eine Vertuschung der Tatumstände zu verhindern.

In dem Kommuniqué der Juristenvereinigung, das von der alternativen kolumbianischen Nachrichtenagentur ANNCOL verbreitet wurde, heißt es: "Am Montag, den 21. Februar 2005, verhafteten uniformierte und bewaffnete Personen, die sich als Angehörige der Brigade XI der
nationalen Armee auswiesen, am Mulatos-Fluss Luis Eduardo Guerra, seinen elfjährigen Sohn Deiner Andrés Guerra, Frau Deyanira Areiza und vier weitere Personen. Sie brachten sie über La Resbalosa zur Finca von Alfonso Bolívar. Der Vorgang war illegal, da die Verhafteten nicht über den Grund ihrer Festnahme oder des Transports über La Resbalosa informiert wurden. Eine der von den Militärs verhafteten Personen konnte fliehen. Am folgenden Tag machte sich die Person, der die Flucht gelungen war, auf die Suche nach den Verhafteten und entdeckte auf dem Gelände der Finca des Herrn Alfonso Bolívar Blutspuren und etwas, das wie ein Grab aussah. Er beseitigte etwas Erde und entdeckte den mißhandelten Körper, von dem angenommen wird, daß es sich um Deiner Andrés Guerra handelt. Angesichts der schwerwiegenden Umstände entschied er sich, seine Suche nicht fortzusetzen und fuhr zum Polizeiposten von San José de Apartadó, wo er den Internen Rat der Gemeinde über die Vorgänge informierte."

Bislang ist der Aufenthaltsort von Luis Eduardo Guerra und den anderen illegal Verhafteten nicht bekannt. Angesichts der vorliegenden Informationen muß befürchtet werden, daß sie Opfer
eines Massakers wurden.

Bei Luis Eduardo Guerra handelt es sich um eine anerkannte Führungspersönlichkeit in der Gemeinde und wurde mehrfach als Sprecher der Einwohner für Gespräche mit der Regierung bestimmt. Dreimal kam er mit dem kolumbianischen Vizepräsidenten Dr. Francisco Santos zusammen, um vorläufige Maßnahmen zu diskutieren, die vom Interamerikanischen Gerichtshof für Menschenrechte der Organisation Amerikanischer Staaten (OAS) am 9. Oktober 2000 beschlossen wurden.

Die Juristenvereinigung weist auch auf einen Vorgang hin, der sich bereits am 20. Februar ereignet hat. Um sechs Uhr morgens drangen Soldaten in einer benachbarten Gegend um sich schießend in das Haus von Frau Fladys Guzmán Palacios ein, die sich dort mit ihrer vierjährigen Tochter Diana Marcela Guzmán und deren Vater, der sich auf Besuch dort aufhielt, befand. Durch die Schüsse, die von den Soldaten im Inneren des Hauses abgegeben wurden, wurde der Mann, bei dem es sich um einen Angehörigen der FARC gehandelt haben soll, getötet und das vierjährige Mädchen verletzt. Das Kind mußte in ein Krankenhaus eingeliefert werden.

Am 22. Februar warfen in der selben Gegend Militärhubschrauber Bomben ab, die das Leben von mehr als 200 Bauern in Gefahr brachten, die dort auf den Feldern arbeiteten.

Die Juristenvereinigung fordert, daß die kolumbianische Regierung dafür sorgt, daß die Abteilung für Menschenrechte der Staatsanwaltschaft und spezialistierte Gerichtsmediziner sofort die
Ermittolungen aufnimmt. Dabei soll auf jeden Fall verhindert werden, daß Angehörige der Brigade XI der Streitkräfte an den Ermittlungen beteiligt werden, um Manipulationen des Tatorts zu verhindern.

COLOMBIAN ARMY MASSACRES MEMBERS OF THE PEACE COMMUNITY OF SAN JOSE DE APARTADO.

EVENTS

On Monday 21 February 2004 in Rio Mulatos, armed and uniformed soldiers who identified themselves as belonging to the XI Brigade of the national Army detained LUIS EDUARDO GUERRA, his 11 year old son DEINER ANDRES GUERRA and DEYANIRA AREIZA and another four as yet unknown people. They took them towards La Resbalosa to a farm owned by ALFONSO BOLIVAR. One of the captives managed to escape from this illegal detention.

The following day, the person who had escaped, set out to look for the other captives. At the farm of Alfonso Bolivar, he found blood stains and what looked like a grave. He removed some of the earth and found the mutilated body of DEINER ANDRES GUERRA. He went immediately to the town of San Jose de Apartado where he informed the Peace Community Internal Council of what had happened. Other campesinos from the area also informed the Council that they had found a grave.

The whereabouts of the other captives remains unknown. Initial information points to a mass killing by the army of members of the Peace Community of San Jose de Apartado.

LUIS EDUARDO GUERRA is a well known leader from the Peace Community Internal Council, and since October 2000 had been acting as one of the negotiators with the government over the implementation of the special security measures that had been ordered by the OAS Inter-American Court of Human Rights. On 3 occasions he had met with Vice President Francisco Santos who had personally assured him that the security measures would be implemented.

BACKGROUND

On 20 February at about 4pm. The army arrived in the village of Nieves near San Jose de Apartado. Two hours later they entered the house of GLADYS GUZMAN PALACIOS and her four year old daughter, and started shooting. They killed the childís father who the army later claimed was a guerrilla from the FARC. They also shot the young girl who is currently in hospital. The 33 Counter-Guerrilla unit of the XVII Brigade of the Colombian Army operate in the area.

On 22 February in the rural areas surrounding San Jose de Apartado, army helicopters carried out a heavy indiscriminate bombing of various villages, putting the lives of 200 villagers at risk. The communities had already been forcibly displaced in December 2004 and again in January 2005 by atrocities committed by the army.

WE ASK THAT YOU IMMEDIATELY REQUEST

1. That the Colombian government immediately send officials form the National Unit for Human Rights, the Attorney Generalís Office and specialists in forensic medicine to properly investigate these events.
2. That no member of the XI Brigade be allowed to participate in the investigations, so that they cannot manipulate the evidence and the investigation itself.
3. That the Colombian army cease all activities against the civilian population in the area of San Jose de Apartado.

COMUNICADO PUBLICO

La Corporación Jurídica Libertad informa a la Comunidad Nacional e Internacional los graves acontecimientos que afectan a la Comunidad de Paz de San Jose de Apartadó y que una vez más vulnera los derechos a la vida y libertad.

HECHOS

El Lunes 21 de febrero de 2004, personal uniformado y armado que se identificó como perteneciente a la Brigada XI del Ejercito nacional retuvo en el río Mulatos, a LUIS EDUARDO GUERRA, a su hijo de 11 años DEINER ANDRES GUERRA, a la señora DEYANIRA AREIZA, y a otros cuatro personas más. Los condujeron hacia la Vereda La Resbalosa a la finca de propiedad de ALFONSO
BOLIVAR. Una de las personas retenidas por los militares logró huir del procedimiento ilegal, ya que no se les informó el motivo de la retención ni del traslado hacia la vereda la Resbalosa.

Al día siguiente, la persona que logró escapar salió a buscar a los retenidos y logró avizorar en la finca del señor Alfonso Bolívar, huellas de sangre y lo que al parecer es una fosa. Removió un poco la tierra y observó el cuerpo mutilado de quien se cree es DEINER ANDRES GUERRA. Ante la gravedad del hallazgo decidió no continuar con la búsqueda y se traslado al casco urbano del corregimiento de San José de Apartadó donde informó lo sucedido al Consejo Interno de la Comunidad de Paz. Otros campesinos de la Vereda igualmente se acercaron al Consejo Interno y comunicaron lo relativo
a la fosa común.

Hasta el momento no se conoce el paradero de LUIS EDUARDO GUERRA ni de las otras personas retenidas ilegal y arbitrariamente. Y con la información sumaria de que se dispone se presume fundadamente que se ha ocasionado una cruel masacre en contra de miembros de la Comunidad de Paz de San Jose de Apartadó.

LUIS EDUARDO GUERRA es un reconocido líder del Consejo Interno de la Comunidad de Paz de San José de Apartadó, y quien ha sido designado para la interlocución con el Gobierno Nacional en el marco de la implementación de las medidas provisionales otorgadas por la Corte Interamericana de Derechos Humanos de la OEA desde el 9 de octubre de 2000. En tres oportunidades se
reunió con el Vicepresidente de la República, Dr. Francisco Santos, quien se había comprometido personalmente en el impulso de las citadas medidas provisionales.

Antecedentes:

El día 20 de febrero de 2005 hacia las 4 a.m. el ejército llego a la vereda las Nieves, del corregimiento de San José de Apartadó, dos horas más tarde entró disparando a la casa de la señora GLADYS GUZMÁN PALACIOS quien se encontraba con su hija DIANA MARCELA GUZMAN de cuatro años de edad y el padre de la menor, quien las visitaba. En los disparos que realizó el
ejército dentro de la casa resultó muerto esta persona, quien era señalado de pertenecer a las milicias de las Farc, y herida la menor Diana Marcela, la que está internada en el hospital de Apartadó. Se tiene conocimiento que el personal militar que se halla en la zona es el 33 contraguerrilla de la
Brigada XVII.

El día 22 de febrero, también en el área rural del corregimiento de San José de Apartadó, en inmediaciones de las Veredas Bellavista, Alto Bonito y Buenos Aires, se presentaron bombardeos indiscriminados por parte de helicópteros del ejército, colocando en riesgo a más de 200 campesinos que habitan dichas veredas. Se había alertado sobre esta situación con la finalidad de evitar el desplazamiento forzado de estas familias, ya que en otras ocasiones como sucedió durante los meses de diciembre de 2004 y enero de 2005 en desarrollo de operativos militares similares se cometieron una
serie de atropellos y de afectaciones a los derechos fundamentales de los campesinos.

PETICIONES URGENTES

En razón de los hechos que se ponen en conocimiento público, solicitamos de manera urgente:

1. Que el gobierno Nacional disponga todo lo necesario para lograr que sea directamente la Unidad Nacional de Derechos Humanos de la Fiscalía y personal especializado de Medicina Legal quien inicie la
respectiva investigación penal por estos graves hechos.
2. Que el Procurador General de la Nación designe a un grupo de sus asesores para que inicie las respectivas investigaciones disciplinarias.
3. Que bajo ninguna circunstancia se permita que personal perteneciente a la Brigada XI del Ejército participe en las diligencias judiciales para evitar la manipulación de la escena del crimen.

A la Comunidad Nacional e internacional solidaria se le propone de manera inminente la conformación de una comisión que se desplace a la zona y acompañe a la Comunidad de Paz de San José de Apartadó en estos trágicos hechos.
