Preparations are reportedly well under way for the amendment of the existing Labor Act and the new rule may come any time in the form of yet another ordinance following Feb 1 takeover. The amended act is most likely to give maximum flexibility to the employer in ascertaining the mode of recruitment (on temporary or daily-wage basis) and there will possibly be no provision of permanent status to workers, say the trade union sources. The amendment is also likely to free the employers from having to give any facilities to the workers except minimum wages and indirectly recruit them through contractors, along with the right to transfer them anywhere, and for any type of work. The government began discussions with the trade unions in this connection on September 29. "The trade union representatives walked out of the final meeting held on November 13 with a note of dissent," said Bishnu Rimal, Vice President of the General Federation of Nepalese Trade Unions. He said the government is also likely to bar the labor organisations to appeal if not satisfied with the final decision on the case currently under consideration at the Labor Court. Laborers said such amendment in the act would breach the past agreement between the work providers and unions, which has the provisions like introducing law that ascertains minimum wage and guaranteeing the fundamental rights declared by International Labor Organisation. The representatives of the World Bank are due to arrive in Kathmandu on Thursday to look into the amended version of the act, which the government is preparing to promulgate shortly. |
